Terms of Service

These Terms of Service ("Terms") govern your use of cardiffcarwash.com (the "Site") and your purchase of car wash, detailing, and membership services from Cardiff Car Wash. By using the Site or purchasing our services, you agree to these Terms. If you do not agree, please do not use the Site or services.

1. Use of the Site

You may use the Site for lawful, personal, non-commercial purposes. You agree not to:

  • Use the Site in any manner that violates applicable law or regulation
  • Attempt to gain unauthorized access to any portion of the Site, servers, or related systems
  • Interfere with or disrupt the operation of the Site or the experience of other users
  • Use automated tools to scrape, harvest, or aggregate Site content without our prior written consent
  • Reproduce, sell, or exploit any portion of the Site for commercial purposes without our express written permission

2. Intellectual Property

All content on the Site — including text, graphics, photographs, videos, logos, the "Cardiff Car Wash" name and marks, our mascot artwork, and the overall design — is the property of Cardiff Car Wash or its licensors and is protected by United States and international copyright, trademark, and other laws. Nothing on the Site grants you any license to use any trademark or content without our prior written permission.

3. Services and Pricing

Wash menu and detailing prices shown on the Site reflect our current standard pricing but are subject to change without notice. Additional charges may apply for oversized or excessively soiled vehicles; any surcharge will be communicated before service begins. Detailing services are by appointment and quoted based on vehicle condition. Posted prices at our location control in the event of a discrepancy.

Rain check. If it rains within 24 hours of your wash, bring your receipt back and we will re-wash the exterior at no charge.

Coupons and offers. Coupons must be presented at check-in, cannot be combined with other offers unless stated, have no cash value, and may be modified or withdrawn at any time.

4. Vehicle Condition and Damage Claims

We take great care with every vehicle. By leaving your vehicle with us for washing or detailing, you agree to the following:

  • Pre-existing damage. We are not responsible for pre-existing damage, including scratches, dents, chips, worn or oxidized paint and clear coat, cracked glass or mirrors, or prior body repairs. Aged, weathered, or previously damaged surfaces may be further affected by ordinary washing; such effects are not our responsibility.
  • Loose items and valuables. Please remove valuables and loose items before service. We are not responsible for loss of or damage to items left in or on the vehicle, including cash, electronics, and accessories.
  • Non-standard equipment. Antennas, bike racks, magnets, emblems, spoilers, wraps, and other aftermarket or loosely attached accessories should be removed or pointed out before service. We are not responsible for damage to items that cannot withstand ordinary hand washing.
  • Claims. Any claim of damage must be reported to a manager before leaving the premises, or within 24 hours with supporting documentation. We will inspect the vehicle and our records and respond promptly and in good faith. Claims reported later than 24 hours after service cannot be verified and may be declined.
  • Right to refuse. We may decline service to any vehicle we determine cannot be safely washed (for example, due to condition, size, or modifications).

5. Memberships and Recurring Billing

Unlimited wash memberships are governed by the following terms, in addition to any terms presented at signup:

  • Automatic renewal. Memberships are billed monthly to your payment method on file and renew automatically each month until canceled. By purchasing a membership you authorize Cardiff Car Wash and its payment processor (Stripe) to charge the recurring monthly fee.
  • Price. The monthly price in effect at signup applies until we notify you of a change. We will provide at least 30 days' notice before any price change takes effect, and you may cancel before the new price applies.
  • One vehicle. Each membership applies to a single vehicle, identified by the license plate provided at signup, and is not transferable between vehicles or persons except by updating your membership with us.
  • Personal use. Memberships are intended for personal, non-commercial use. Commercial and fleet use requires a separate arrangement.
  • Cancellation. You may cancel at any time — in person, by phone at (760) 436-1820, or by email to info@cardiffcarwash.com — and cancellation takes effect at the end of the current paid billing period. No further charges will be made after cancellation. Except where required by law, monthly fees already paid are not prorated or refunded.
  • Failed payments. If a recurring charge fails, we may suspend membership benefits until payment is brought current.
  • Program changes. We may modify or discontinue the membership program with reasonable notice; if we discontinue your membership mid-period, we will refund the unused portion of that month.
  • Abuse. We may cancel a membership for misuse (including plate sharing or commercial use), with a refund of the unused portion of the current period.

6. Online Purchases

Online membership signup and any online payments are processed by Stripe on secure payment pages. You agree to provide accurate, current information and represent that you are authorized to use the payment method provided. Confirmation of an online purchase will be shown on-screen and/or sent to the email address you provide.

7. Third-Party Links and Content

The Site may link to external websites and services (maps, review platforms, social media, our online signup pages). We do not control and are not responsible for the content or practices of third-party sites. Your use of them is at your own risk and subject to their terms.

8. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. THIS SECTION APPLIES TO THE WEBSITE; IT DOES NOT LIMIT ANY NON-WAIVABLE RIGHTS YOU HAVE UNDER CALIFORNIA LAW WITH RESPECT TO SERVICES PERFORMED ON YOUR VEHICLE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CARDIFF CAR WASH, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). CLAIMS RELATING TO SERVICES PERFORMED ON YOUR VEHICLE ARE HANDLED UNDER SECTION 4 AND APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU IN FULL.

10. Indemnification

You agree to defend, indemnify, and hold harmless Cardiff Car Wash, its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your violation of any rights of another.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising from or relating to these Terms, the Site, or our services shall be resolved in the state or federal courts located in San Diego County, California, and you consent to the jurisdiction and venue of those courts.

12. Changes to These Terms

We may update these Terms at any time. Updates take effect when posted, except that material changes to membership terms will be communicated with at least 30 days' notice. Your continued use after changes are posted constitutes acceptance.

13. Termination; Severability

We may suspend or terminate your access to the Site at any time for violation of these Terms. If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.
